These terms and conditions govern your access to and use of the content and services provided on this website, establishing an agreement between you and Chun Gymnastics.

Chun Gymnastics ("Chun Gymnastics"/"we"/"us"/"our") is the owner and operator of www.chungymnasticsmalta.com (the website). By using, viewing, transmitting, caching, storing, and/or otherwise utilizing this website, its services or functions, and/or the contents or information provided herein, you agree to comply with all the terms and conditions stated here. You waive any right to claim ambiguity or error in this Agreement. If you do not agree with all the terms and conditions, please refrain from using this website and leave immediately.

By using the services, you confirm to Chun Gymnastics that you have the legal capacity to enter into these Terms and Conditions with us.

1. Description of Service/Product

Through this website, we provide general information about our objectives, tasks, achievements, programs, facilities, activities, services, and events. We also offer the option to register as a member and make online purchases for available gymnastics programs.

2. Online payments

Any online purchases made on this website will be charged at the advertised price on the date of the order. All prices displayed on the website are in Euro and include VAT.

We reserve the right to review and modify the prices advertised on our website periodically.

While we strive to ensure the accuracy of all prices on our website, errors may occur. In the event of a pricing error for goods you have purchased, we will inform you promptly and provide the option to confirm your purchase at the correct price or cancel it. If you choose to cancel and have already made payment, you will receive a full refund.

3. Payment Method and Security

We accept online purchases only with payment by credit/debit card.

Your card details are directly received and processed by our payment gateway (PSP), Stripe. Your card details are transmitted from you to the payment gateway (PSP) encrypted using high-strength SSL for maximum protection and confidentiality. Chun Gymnastics does not handle the card information at any point.

For added security, the three-digit security code (CVV/CVC2) on the back of your card is never stored by the payment gateway (PSP). Without this number, any unauthorized attempts to make additional transactions on your card will be rejected.

The payment gateway (PSP) is licensed and authorized by Visa, MasterCard, and other card associations to serve as a payment gateway. It undergoes regular audits and complies with the Payment Card Industry Security Standards.

You agree to provide accurate details to Chun Gymnastics when placing orders or purchasing goods/services from this website.

You also confirm that the credit or debit card used for the transaction is your own and that there are sufficient funds to cover the cost of the goods or services ordered/purchased.

4. Communication

Consent for Communication

By providing us with your email address, you consent to the use of email as a means of long-distance communication by Chun Gymnastics to contact you as necessary, in accordance with our Privacy Policy and applicable EU data protection laws.

5. Conclusion of the Contract

5.1 Formation of the Contract

Upon purchasing one of our gymnastics programs, a legally binding electronic contract between you and Chun Gymnastics is concluded upon your receipt of our confirmatory email, which serves as the receipt of your purchase. This email includes all relevant statutory information related to your contract and provides a link to these terms and conditions.

5.2 Verification and Retention of Receipt

It is your responsibility to promptly verify the accuracy of the details on your receipt. We recommend printing and retaining a copy of the receipt for your records.

5.3 Right of Withdrawal and Refunds

If you decide to withdraw from the contract in accordance with these terms and conditions, you must notify us. Any payment debited from your credit card will be re-credited to your account as soon as possible and, in any event, within thirty (30) days of your purchase. In the event of accidental overbooking or cancellation of a program, you have the right to cancel the agreement and receive a full refund, credited to your credit card account within 30 days of purchase.

6. Liability

6.1 Information Accuracy and Limitation of Liability

While we strive to provide accurate information on this website, we do not accept liability for errors and omissions (except as stated below). We reserve the right to change information, prices, specifications, and descriptions of listed services. In the event of a pricing error, we will inform you promptly in accordance with these terms and conditions. We will make reasonable efforts to correct errors and omissions promptly upon becoming aware of them.

6.2 Disclaimers

To the fullest extent permitted by law, Chun Gymnastics provides this website and its contents on an "as is" basis. We expressly disclaim all representations or warranties of any kind, express or implied, including but not limited to warranties of merchantability and fitness for a particular purpose. Additionally, we do not represent or warrant that the information accessible via this website is accurate, complete, or current.

6.3 Modifications and Termination

We reserve the right to make changes to the material, details, products, and services described on the website without prior notice. We may modify or discontinue products and services, temporarily or permanently, without liability. 8. Applicable Law and Jurisdiction

8.1 Governing Law

This website operates under Maltese jurisdiction and is subject to the laws of the Republic of Malta.

8.2 Location of Purchase

Every purchase made through the website is deemed to be performed in Malta. The electronic contractual agreement between you and Chun Gymnastics, regarding purchases from the website, is governed by Maltese law.

8.3 Jurisdiction

Any disputes arising from the use of this website and/or the electronic contractual agreement between you and Chun Gymnastics shall be exclusively subject to the jurisdiction of the Courts of Justice of Malta.

9. Miscellaneous

9.1 Non-Waiver of Breach

Any failure or delay by Chun Gymnastics in exercising its rights to address a breach of these terms and conditions shall not be deemed as a waiver of any subsequent breach of the same or any other provision.

9.2 Website Usage Restrictions

You are prohibited from permitting or engaging in unauthorised framing, deep linking, or the creation of derivative works from the website on any other website under your management or control.

9.3 Criminal Offence of False Information

Using a false name or a known invalid credit card to order or purchase products or services online is considered a criminal offence. Individuals found wilfully engaging in such fraudulent activities will be prosecuted to the fullest extent of the law.

9.4 Ownership of Website Content

Except for third-party content, Chun Gymnastics holds exclusive ownership rights over all content on this website, including intellectual property rights, text, images, audio, video, and other materials.

9.5 Limited Use of Website Content

You acknowledge and accept that the website content may only be used for personal and non-commercial purposes, provided that you appropriately attribute the content. Any other use is strictly prohibited unless expressly authorised in writing by Chun Gymnastics.

10.  Chun Gymnastics Programmes Terms & Conditions

10.1 Booking, Confirmation, Data, and Communication

10.1.1   Booking and Payment

Booking and payment can only be made through the official Chun Gymnastics website at https://in.app.link/J64OEGzh2zb or the In2 application for the Chun Gymnastics Business account. Bookings made in person at any Chun Gymnastics office or by post will not be accepted. Applications are processed on a first-come, first-served basis. An email confirmation of the booking will be sent immediately upon acceptance. If you do not receive the confirmation email, please check your spam/junk folder. Should clients book incorrectly and require a refund from Stripe the rate shall be 3.1% + €0.50.

10.1.2 Personal Data and Confidentiality

All requested personal data must be provided. The information provided will be treated with the utmost confidentiality. It is your responsibility to provide accurate data and inform us of any changes. Please note that activities may be photographed and filmed for media coverage, including TV, magazines, newspapers, billboards, websites, and social media. The personal data provided will be included in the Chun Gymnastics database and may be used to provide information about future activities and programs through email, post, or SMS. Your data will not be disclosed to third parties.

10.1.3 Data Protection and Application Processing

Chun Gymnastics collects and processes information in accordance with the Data Protection Act 2000 to carry out its functions. The information may be shared with other departments involved in the application process. Providing this information is not mandatory, but please be aware that failure to do so may result in the department being unable to process your application.

10.2 Changes and Cancelled Programs

10.2.1 Program Changes and Cancellations

Chun Gymnastics reserves the right to cancel or make changes to any program as deemed necessary. Refunds will only be issued if a program is changed or cancelled by Chun Gymnastics.

10.2.2 Weather-related and Health Authority Cancellations

Sessions may be cancelled due to inclement weather conditions. In such cases, no refunds will be given. Chun Gymnastics will not issue any refunds if sessions are cancelled based on directives from the Health Authority.

10.3 Medical, Health, Injuries, Fit to Participate

10.3.1 Fitness to Participate

Participants must ensure that they are physically fit to engage in sports activities that involve vigorous physical exertion. In the case of children, parents/guardians are responsible for ensuring their child's fitness to participate.

10.3.2 Injuries and Liability

While all necessary precautions are taken to prevent accidents and injuries, accidents can still occur. Chun Gymnastics is not liable for any injuries sustained during the sessions.

No refunds will be provided if a participant is unable to continue the program due to an injury or change in health condition.

10.4 Attendance, Behaviour, and Termination

10.4.1 Attendance and Collection of Children

Parents are required to bring and collect their children from inside the designated venues or as instructed by the administration. In some cases, parents may be requested to drop off and pick up children from a specific location outside the venue, as communicated by the administration via email.

10.4.2 Failure to Attend and Dismissal

Failing to attend three consecutive sessions without notifying the Head Coach will be considered a withdrawal from participation. In such cases, we reserve the right to offer the place to another applicant.

Any misbehaviour by a child may result in dismissal from the program. Dismissal can be immediate and will be notified on the same day. Chun Gymnastics' decision in such matters is final. No refunds will be provided in these cases.

10.4.3 Termination of Agreement

We reserve the right to terminate any agreement related to sports programs immediately and without notice in the following circumstances:

• Failure to make payment when due

• Breach of these terms and conditions or our Privacy Policy (whether repeated or otherwise)

• Failure to provide us with sufficient information to verify the accuracy and validity of any information supplied by you or your identity, when requested to do so within a reasonable time

• Suspected engagement in or involvement with fraudulent or illegal activity on the website.

Chun Gymnastics reserves the right to make amendments to these terms and conditions as necessary. Any revised version of the terms and conditions will be posted on the website. All purchases made after the updated terms and conditions are posted will be governed by the new terms and conditions. By continuing to use the website after the changes have been posted, you are indicating your acceptance of the revised terms and conditions. If you do not agree with any modifications to these terms and conditions, it is recommended that you discontinue using the website.

These terms and conditions supersede any previous conditions, understandings, commitments, agreements, or representations (except fraudulent misrepresentations) regarding your purchase, whether they were oral or in writing. They constitute the entire agreement between Chun Gymnastics and you concerning your purchase. Chun Gymnastics advises you to print and retain a copy of these terms and conditions after your order has been accepted. We will also store a copy of the contract you entered into with Chun Gymnastics. It is your responsibility to read and fully understand all the information provided on this website.

If any provision of these terms and conditions is deemed invalid or unenforceable by a competent authority, the validity of the remaining provisions and the unaffected portions of the provision in question will remain in effect.
